How To File Petition

Any Licensee, generating company, electricity consumer or any other stake holder in Haryana may file a petition clearly stating the provisions of the Electricity Act 2003, Haryana Electricity Reforms Act 1997 or regulations framed there under and Conduct of Business Regulations notified by the Commission. The petition has to be complete in all respect including fees as prescribed in HERC Fee Regulation, 2005View Document( 82 Kb) as amended from time to time.

The Commission may permit any associations, groups, forums or other bodies corporate or any group of consumers to participate in any proceedings before the Commission on such terms and conditions including in regard to the nature and extent of participation as the Commission may consider appropriate. (Regulation 21 of Conduct of Business Regulations, 2004 of the Commission)

The petition should be filed as per the procedure prescribed in Conduct of Business Regulations, 2004View Document(205 Kb) of the Commission. The salient points to be kept in mind, while filing the petition, are given below:

  1. All Pleadings shall be typewritten, cyclostyled or printed neatly and legibly on both side of white paper and every page shall be consecutively numbered. Their contents should be divided appropriately into separate paragraphs, which shall be numbered serially. Ten copies of each pleading complete in all respects shall be filed subject to any other requirement, which the Commission may specify from time to time.   2. All Pleadings shall set out clearly and concisely: (Regulation 27 of Conduct of Business Regulations, 2004 of the Commission)
    1. Statement of the relief sought from the Commission; and
    2. The reasons why the Commission should grant the requested relief.
  3. General headings (Regulation 28 of Conduct of Business Regulations, 2004 of the Commission) The general heading in all Pleadings before the Commission and in all advertisements and notices shall be in Form 1View Document( 22 Kb).
  4. Affidavit in support (Regulation 29 of Conduct of Business Regulations, 2004 of the Commission)
    1. All pleadings shall be verified by an affidavit and every such affidavit shall be in Form 2View Document( 26 Kb) of Conduct of Business Regulations, 2004.
  5. The Proceedings of the Commission shall normally be conducted in English, provided that the Commission may allow any person to plead or represent the case in Hindi. (Regulation 10 of Conduct of Business Regulations, 2004 of the Commission)
